New Safety Apparel Regulation

I was recently informed of a new Safety Apparel Regulation effective November 24, 2008, federal mandate, 23 CFR 634. This mandate states *" All workers within the right-of-way of a Federal-aid highway who are exposed either to traffic (vehicles using the highway for purpose of travel)or construction equipment within the work area shall wear hi-visibility safety apparel." *

As I understand this regulation it effects any workers on foot within the right-of-way of federal-aid highway: construction, survey crews, first responders, law enforcement and tow truck drivers are effected to name a few.

This is how the FHWA defines Hi-Visibility Safety Apparel, it is intended to stand out during both daytime and nighttime usage which meets the requirements of ANSI/ISEA 107-2004 performance class 2 or 3. ANSI/ISEA requires that class 2 has at least 775 square inches of hi-vis and the fluorescent background must be at least 201 square inches of reflective material.

This regulation effects many workers on federal-aid highways and those whom do not adhere to the mandate could face costly fines from OSHA.
